Privacy Policy
This privacy policy applies to the software application Oblik Design, created by CustomFitVR LLC. The Oblik Design application (the “App”) is a mobile application that allows you to place orders for custom-designed and custom-made virtual reality (VR) face gaskets (“Custom Face Gaskets”) for several VR systems. The face gaskets are designed based on your facial geometry and we refer to such designs as “Virtual Prototypes”.
Collection of Personal Information
We do not collect any personal information about you unless you voluntarily provide it to us. However, you may be required to provide certain personal information to us when you elect to use certain features of our App and the services that we provide, as described in sections below.
Face Scan Data
We collect multiple frames of depth map data from iPhone’s TrueDepth camera where each frame represents a partial three-dimensional scan of your face from a particular angle. No color or photographic information is collected through this process, and the data is filtered to include only the portion of your face that is needed for Virtual Prototypes.
A Face Scan is only transmitted to our servers for processing when you request a Virtual Prototypes or explicitly request the Face Scan to be uploaded.
You can delete a Face Scan directly in the App, which will cause it to be deleted from both your device and our servers. If a Face Scan is used in Virtual Prototype(s), you will first need to delete the Virtual Prototype(s).
Portrait Photos
The App collects still images of your face (“Portrait Photo”) at the beginning of the face scanning process. These photos are used by the App to help you discern Face Scans and Virtual Prototypes, and are helpful when you use the App to order Custom Face Gaskets for other individuals (for example, other members of your household).
Portrait Photos are only stored on your device and are never transmitted to our servers. If you delete the App, all Portrait Photos will be permanently lost.
Registration Information
You are required to register before you can request and view Virtual Prototypes. When you register, we collect your First and Last name, and an E-mail Address. We use this information to identify you as a user in our system and associate you with other data, such as Virtual Prototypes and any Orders that you may place.
Order Information
At the time that you place an Order in our system, we collect the following information:
First and Last Name (of the shipping recipient)
Shipping Address
Shipping Contact E-Mail
For payment information, we receive an Apple Pay token that we securely process through our payment processing provider. We do not directly collect or store your payment information, such as credit card numbers or bank account numbers.
Survey and User Feedback Information
We collect survey information in the App that is directly relevant to our goal of designing and producing Custom Face Gaskets that fit you perfectly.
Before you submit a request for a Virtual Prototype, we ask about your current face gasket solution and the specific areas where you may have fit issues. We use this information as an input into the design of Virtual Prototypes.
After you receive your Order, we ask for your feedback on the degree to which we addressed the fit issues you reported.
If you encounter fit issues with you Order, we ask for your input on the specific fit issues so that we may determine the best way to remedy the situation (replacement or return for refund).
We also collect your general feedback unrelated to Virtual Prototypes or Orders, such as:
Upvoting a VR system that we do not yet support
Requesting that you be included in a beta test of a new Custom Face Gasket design
Use of your Personal Information
CustomFitVR LLC collects and uses your personal information to operate and deliver the services you have requested.
Sharing Information with Third Parties
CustomFitVR LLC does not share Face Scan data with any third parties. Face Scan data is accessed and processed solely by us.
CustomFitVR LLC does not share you individual Survey and User Feedback Information with any third parties. CustomFitVR LLC may share aggregated Survey and User Feedback Information in a manner that does not identify you and cannot be used to indirectly identify you.
CustomFitVR LLC does not share its customer lists or customer contact information with any third parties.
CustomFitVR LLC uses trusted partners for payment processing and shipping services, and shares data necessary for them to perform their services on our behalf. All such third parties are prohibited from using your personal information except to provide these services to CustomFitVR LLC, and they are required to maintain the confidentiality of your information.
CustomFitVR LLC may disclose your personal information, without notice, if required to do so by law or in the good faith belief that such action is necessary to: (a) conform to the edicts of the law or comply with legal process served on CustomFitVR LLC or the site; (b) protect and defend the rights or property of CustomFitVR LLC; and/or (c) act under exigent circumstances to protect the personal safety of users of CustomFitVR LLC, or the public.
Right to Deletion
Subject to certain exceptions set out below, on receipt of a verifiable request from you, we will:
Delete your personal information from our records; and
Direct any service providers to delete your personal information from their records.
Please note that we may not be able to comply with requests to delete your personal information if it is necessary to:
Complete the transaction for which the personal information was collected, fulfill the terms of a written warranty or product recall conducted in accordance with federal law, provide a good or service requested by you, or reasonably anticipated within the context of our ongoing business relationship with you, or otherwise perform a contract between you and us;
Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity; or prosecute those responsible for that activity;
Debug to identify and repair errors that impair existing intended functionality;
Comply with the California Electronic Communications Privacy Act;
Enable solely internal uses that are reasonably aligned with your expectations based on your relationship with us;
Comply with an existing legal obligation; or
Otherwise use your personal information, internally, in a lawful manner that is compatible with the context in which you provided the information.
Children Under Thirteen
CustomFitVR LLC does not knowingly collect personally identifiable information from children under the age of thirteen. If you are under the age of thirteen, you must ask your parent or guardian for permission to use this application.
E-mail Communications
From time to time, CustomFitVR LLC may contact you via email for the purpose of providing announcements, promotional offers, alerts, confirmations, surveys, and/or other general communication.
If you would like to stop receiving marketing or promotional communications via email from CustomFitVR LLC, you may opt out of such communications by clicking the "Unsubscribe" link.
External Data Storage Sites
We may store your data on servers provided by third party hosting vendors with whom we have contracted.
Changes to this Statement
CustomFitVR LLC reserves the right to change this Privacy Policy from time to time. We will notify you about significant changes in the way we treat personal information by sending a notice to the primary email address specified in your account, by placing a prominent notice on our application, and/or by updating any privacy information. Your continued use of the application and/or Services available after such modifications will constitute your: (a) acknowledgment of the modified Privacy Policy; and (b) agreement to abide and be bound by that Policy.
